TERMS AND CONDITIONS

This website, found under the www.carrolboyes.biz is operated by Wyecroft Limited trading as Carrol Boyes (" hereinafter called Carrol Boyes") and references to "we", "us" and "our" shall be deemed to be references to Carrol Boyes. References to "you", and "your" shall be deemed to be references to any person placing an order via this website.

a.       By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these terms, then you should contact us either by telephone on 01428 652 628, by email to info@carrolboyes.co.uk or by post using the address given below.

b.      By placing an order via this website you are making an offer to Carrol Boyes to purchase the goods detailed in your order upon the terms described in your order.

c.       Once you have placed an order we will send you a confirmation that your order has been received but this is not a confirmation that your offer to purchase the goods has been accepted. A contract between you and Carrol Boyes for the sale of our products will only exist once an order has been accepted, processed and despatched to you.

d.      Your credit/debit card will be authorised when your order is placed and processed but you will not be charged for the value of the goods until the point that they are despatched to you. This does not affect your statutory rights.

e.       The prices shown on the website are correct at the time of going to press, however prices and availability of goods are subject to change without notice. A delivery charge will be added to your order value where appropriate, please refer to Delivery and Delivery Charges.

2.      YOUR RIGHT TO CANCEL

You may normally cancel your order (once accepted by us) for any reason up to the point of despatch. If you do cancel the contract within this time any payments made by you will be refunded in full within 30 days.

3.      RETURNS POLICY

a.       If you are not entirely delighted with the products that you have chosen you may return them to us within 28 days of receipt. We will be more than happy to offer you an exchange, a credit voucher or a full refund provided that the products are returned complete, in perfect condition, unused, unwashed and with the original packaging and original invoice or till receipt. Please take extra care to read our Product Care Information page or our Cleaning Instructions enclosed with your order as we cannot accept items back if they are not in perfect condition or it is obvious to us that the goods have been used or washed or damaged.

b.      For all returns, except where the item is faulty, you will be required to arrange and pay for the return of the products to us.  We will only issue a refund for the costs of return postage where the item returned is faulty.

c.       To return any products to us, please complete the reverse side of the invoice (which comes with your order) and clearly mark whether you would like a refund in the form of a cash refund. credit voucher or exchange. Pack the items back in the parcel, attach the invoice and send it back to:

When returning items you are strongly recommended to obtain proof of posting. We cannot accept responsibility for parcels lost in transit.

4.      PAYMENT AND TAXES
We accept online payment in a secure environment by credit card or Carrol Boyes Gift Vouchers. We currently accept Visa, Mastercard, Delta, Switch. All transactions are shown in pounds sterling (£).

6.      OUR PLEDGE TO YOU

a.       If your credit/debit card is used fraudulently as a direct result of being used to buy from our site, then we will assume liability for the first £50 of your loss. Your credit card company is obligated to take responsibility for the rest. We will use our reasonable endeavours to work with your credit card company to minimise the inconvenience for you.

>b.      We endeavour to display through this website all items which we hold in stock in the UK. However, occasionally an item will be out of stock and if this is the case this will be highlighted in your shopping basket. The stock status for your order will also be notified to you on your order confirmation.

c.       All dates quoted for delivery are estimated delivery dates only and may be subject to change and we can accept no liability for any loss or damage (whether direct or indirect) for delivery at any time other than the estimated date for delivery. All orders received and accepted before 4pm will, subject to availability, be despatched on the following day for a 7 working day delivery. Those orders received and accepted after 4pm will be despatched on the day after the next day.

7.      DELIVERY

a.       Stock permitting, all orders are usually despatched within 24 hours of being accepted, to arrive with UK customers within 4 working days. In the event that an item is temporarily out of stock, we will notify you of the delay and despatch it as soon as it arrives.

b.      All delivery charges are quoted in British Pounds, inclusive of VAT and per parcel per address. 

c.       Delivery charges are calculated per parcel where a parcel is a maximum of 30kg in weight, 1.5m long and 3m length and girth combined.  We will combine as many items as possible to make up a parcel to ensure that your delivery charges are as low as possible.

8.      CONFORMITY OF GOODS

Every possible step is taken to ensure that the description of the products are correct.  It must however be noted that the description and specifications are not intended to be binding and are intended to be a general description of the product.  Each item is individually handmade and will differ slightly from another item with the same description.

9.      DISCLAIMER & LIMITATIONS OF LIABILITY

a.       To the fullest extent permitted by law and save as provided above, neither Carrol Boyes nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Carrol Boyes or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.

>b.      While Carrol Boyes uses reasonable endeavours to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness and Carrol Boyes will not be responsible for any errors or omissions or for the results arising from the use of such information.

c.       While Carrol Boyes takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of this website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

d.      The entire liability of Carrol Boyes under or in connection with any contract for any products to which these conditions apply shall not exceed the price of the products, except as expressly provided in these conditions.

e.       Carrol Boyes will not be liable to you or be deemed to be in breach of these terms and conditions or any other contract with you by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.

f.       Carrol Boyes may assign or transfer any of its rights or sub contract any of its obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with the specific permission in writing of Carrol Boyes.

g.      No person who is not a party to these terms and conditions shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.

The contents of these pages (including pictures, designs, logos, photographs, text written and other materials) are the copyright trademark or registered trademark of Carrol Boyes or Carrol Boyes (Pty) Limited, a company registered in South Africa,  or its content and technology providers or their respective owners. 11.  LAW AND TERRITORY

a.       These Terms and Conditions and your use of our website are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights.

b.      This website and our Terms and Conditions have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.

12.  PRIVACY POLICY

a.       Carrol Boyes is committed to protecting your privacy.  We only hold the information supplied by you for the purpose of processing orders and for sending solicited emails about Carrol Boyes products.  To prevent unauthorised access, to maintain data accuracy and to ensure the correct use of information we have attempted to put in place appropriate physical, electronic and managerial procedures to safeguard and keep secure all the information which we receive online.

b.      When placing an order we require details such as your name, billing address, delivery address, phone number and email address.  This information is transferred to our server using Secure Sockets Layer encryption which provides communications privacy over the Internet.
